Single User License
This is for a single user only. It can be used to "train" as many people, as you like, inside or outside of your company by the user assigned the license. Under this license, TGI Licenses are issued for the lifetime use of the product unless otherwise indicated (Note: Certain TGI products licenses are offered as both Annual (Expire one year from purchase) and Lifetime Licenses. 10-User License (purchase multiples for larger groups)
This is a single limited business license and can be used or distributed to up to 10 employees inside of your company. It cannot be sold or distributed to anyone outside of your company. It can be used to "train" as many people, as you like, inside or outside of your company. Buy multiple copies of this license to equal the number of users that will have access to this software. TGI Licenses are issued for the lifetime use of the product unless otherwise indicated (Note: Certain TGI products licenses are offered as both Annual (Expire one year from purchase) and Lifetime Licenses. Enterprise License
This is a single limited business license and can be used by or distributed to ALL EMPLOYEES inside of your company. It cannot be sold or distributed to anyone outside of your company. It can be used to "train" as many people, as you like, inside or outside of your company. TGI Licenses are issued for the lifetime use of the product unless otherwise indicated (Note: Certain TGI products licenses are offered as both Annual (Expire one year from purchase) and Lifetime Licenses. Affiliate License
This license is designed for consultants, presenters, educators and trainers that wish to customize and resell TGI products to support their own programs. In order for a company to resell TGI products, they must purchase an Affiliate License for each TGI product they wish to resell and have a current and valid TGI Affiliate Agreement in effect. TGI Licenses are issued for the lifetime use of the product unless otherwise indicated (Note: Certain TGI products licenses are offered as both Annual (Expire one year from purchase) and Lifetime Licenses. Once contracted with TGI, the Affiliates License entitles the Sales Affiliate to customize and resell the TGI product (for which the license was purchased) to their customer base. Note: Customization of a TGI Game involves the affiliate adding proprietary questions, graphics, sounds, logos or any other open setup feature within the TGI product purchased, for the purpose of reselling the finished product to their own customer base. It does not include accessing or modifying any protected sheets or VBA modules within the TGI program.

For additional charges, TGI can perform the following services to support our affiliates:

1. Assist the affiliate with the TGI product customization.
2. Place the TGI product within an automated installation program which can be delivered via e-mail link or on CD.
3. Place the affiliate’s customized TGI product on a CD (With CD label and labeled jewel case).
4. Deliver customized TGI Product via e-mail link to the affiliate customers.
5. Deliver customized TGI Product via mail on CD.
6. Cross marketing opportunities – call us to discuss.

Affiliate restrictions include the following:

1. The objective of this program is to allow affiliates to utilize the TGI product to input their own questions, graphics, and presentation information into the TGI game product and then sell this unique product offer to their own customers. No un-customized, standard, or stand-alone TGI product can be sold under this license agreement.
2. All published (internet, etc.) pricing for customized TGI games must be sold for the same or greater price than the normal published TGI price on our web site.
3. Affiliate customized TGI game products are subject to approval by TGI. We reserve the right to terminate this license agreement at any time if TGI determines that the affiliate is in violation of the above stated intent and objective of this agreement.

TGI Partners License
TGI makes available (6) of our most popular products for sale on partnering websites. In order for a company to participate in the TGI partners program, they must have a current and valid TGI Partners Agreement in effect. This agreement entitles the TGI partner to the following:

1. To receive 43% (based on current retail pricing) commission for the sale of the 6 TGI products.
2. TGI will develop the web page for all TGI partners which must be placed on the partner’s website with a link to this page from the Home Page of the partner’s website.
3. TGI will make available to each partner on-line reporting of all sales occurring through the partner’s website of TGI products.

TGI will send commission checks to partnering account on or before the tenth of each month.

TRAINING GAMES, INC. STANDARD LICENSE FOR ALL PRODUCTS

You should carefully read the following terms and conditions before using this software. Unless you have a different license agreement signed by Training Games, Inc. ("TGI") your use, distribution, or installation of this software indicates your acceptance of this License.

If you do not agree to any of the terms of this License, then do not install, distribute or use this software. If you paid TGI or an authorized TGI distributor for this copy individually, you may return it unused, within seven (7) days after purchase, for a full refund of your payment. Once the product is opened (a marker is triggered in the program) it is not returnable.

This software may either be used by a single person who uses the software personally on one or more computers, or installed on a single workstation used non-simultaneously by multiple people, but not both. This is not a concurrent use license. Additional Licenses can be purchased from www.training-games.com.

You may access this software through a network, provided that you have obtained a quantity of 10-User Licenses equal to the number of people authorized to use this software.

THIS SOFTWARE, AND ALL ACCOMPANYING FILES, DATA AND MATERIALS, ARE DISTRIBUTED "AS IS" AND WITH NO WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. THE USER ASSUMES THE ENTIRE RISK OF USING THIS SOFTWARE. THIS DISCLAIMER OF WARRANTY CONSTITUTES AN ESSENTIAL PART OF THE AGREEMENT.

ANY LIABILITY OF TGI WILL BE LIMITED EXCLUSIVELY TO REFUND OF PURCHASE PRICE. IN ADDITION, IN NO EVENT SHALL TGI, OR ITS PRINCIPALS, SHAREHOLDERS, OFFICERS, EMPLOYEES, AFFILIATES, CONTRACTORS, SUBSIDIARIES, OR PARENT ORGANIZATIONS, BE LIABLE FOR ANY INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES WHATSOEVER RELATING TO THE USE OF THIS SOFTWARE, OR YOUR RELATIONSHIP WITH TGI.

This Agreement is the complete statement of the Agreement between the parties on the subject matter, and merges and supersedes all other or prior understandings, purchase orders, agreements and arrangements. All rights of any kind in this software which are not expressly granted in this License are entirely and exclusively reserved to and by TGI. You may not sell, rent, lease, modify, translate, reverse engineer, de-compile, disassemble or create derivative works based on this software. The VBA source code is protected and may not be incorporated into other commercial products. There are no third party beneficiaries of any promises, obligations or representations made by TGI herein.

If you have purchased an Affiliate License, you may sell this product to your customers for their own internal use under the terms of the Single or 10-User License. You are required to remit 50% of any proceeds you receive from the sale of our products to Training Games, Inc., 4545 E. Hedgehog Place, Cave Creek, AZ 85331 within 30 days of sale. The minimum sale price for reselling this software is the current posted prices on the www.training-games.com web site. Sales to larger companies where more than 10 users are involved must following the pricing strategies of TGI. Upon verification by TGI that you have not transmitted all proceeds due within the 30-day time frame, your Affiliate License will be revoked.

TGI TRIAL OR EVALUATION SOFTWARE

The above Standard License Agreement applies to any trial or evaluation versions of our software except as stated below:

This is not free software. You are hereby licensed by Training Games, Inc. ("TGI") to use this software for evaluation purposes without charge for up to 30 days. After the 30-day evaluation period you must remove all of the trial version files from your computer systems. You may not give or distribute copies of this software to anyone.
